Regulatory status

ASTERALE is registered with ORIAS, the French register of insurance, banking and finance intermediaries, under no. 23 007 423 (register available at www.orias.fr) as:

• a financial investment adviser (conseiller en investissements financiers, CIF), member of ANACOFI-CIF, 92 rue d'Amsterdam, 75009 Paris, a professional association approved by the Autorité des marchés financiers (AMF), 17 place de la Bourse, 75082 Paris Cedex 02 (www.amf-france.org);
• an insurance broker (courtier en assurance, COA);
• an insurance intermediary's agent (mandataire d'intermédiaire d'assurance, MIA);
• an agent of a banking and payment services intermediary (mandataire d'intermédiaire en opérations de banque et en services de paiement, MIOBSP).

ASTERALE holds the professional licence « Transactions sur immeubles et fonds de commerce » (transactions in real property and businesses) no. CPI 8501 2023 000 000 004, issued by the Paris Chamber of Commerce and Industry, with no client funds held.

ASTERALE is subject to the supervision of the Autorité de contrôle prudentiel et de résolution (ACPR), 4 place de Budapest, CS 92459, 75436 Paris Cedex 09 (acpr.banque-france.fr).

ASTERALE is covered by professional indemnity insurance, policy no. 7400023129, taken out with Zurich Insurance plc, 112 avenue de Wagram, 75017 Paris.

ASTERALE neither collects nor holds funds on behalf of its clients. It is therefore not subject to the financial guarantee requirement and has no financial guarantee.

ASTERALE carries out no crowdfunding activity: the firm is neither a crowdfunding investment adviser (CIP) nor a crowdfunding service provider (PSFP). It does not manage portfolios on behalf of third parties.

Nature of the advice under MiFID II

ASTERALE has no capital ties with any bank, insurer or asset management company. The firm is neither a subsidiary nor an exclusive agent of any financial institution. It selects solutions from across the market, which the site refers to as "open architecture".

Investment advice is provided on a non-independent basis.

This classification derives from MiFID II, as transposed into French law. It arises because the firm may receive commissions (rétrocessions), in its capacity as insurance broker and banking intermediary, from insurance companies, asset management companies or the institutions distributing the solutions subscribed.

The firm receives fees and commissions. Their nature and amount are disclosed in writing in the client information document, in the engagement letter and before any subscription.

Client information document

In accordance with Article 325-5 of the AMF General Regulation, ASTERALE gives each client, before any advisory service, a client information document (document d'entrée en relation). This document sets out the identity of the firm and its representative, its regulatory statuses and registration numbers, its supervisory authority, the approved professional association it belongs to, its methods of remuneration (fees, commissions, charges), the nature of its advice under MiFID II, its conflicts-of-interest policy and the procedures for complaints and mediation. Conflicts of interest

In accordance with Articles 325-28 et seq. of the AMF General Regulation, ASTERALE applies a conflicts-of-interest policy, available on request. This policy provides for:

• the identification of potential conflict situations;
• the assessment of the suitability of solutions for the client's situation, which takes precedence over the firm's commercial interests;
• disclosure to the client where a conflict is identified;
• refusal to provide the service where the conflict cannot be satisfactorily resolved.

Intellectual property

All content on the asterale.fr website (texts, fact sheets, illustrations, logo, graphic identity) is the property of ASTERALE or is used under licence. Any reproduction, representation, modification or use, in whole or in part, by any means, is prohibited without ASTERALE's prior written consent. The ASTERALE name and logo are protected under trade mark law (trade mark registered with the INPI, the French intellectual property office).

The site may contain links to other sites, in particular gazania.fr and cassinia.fr, the websites of the ASTÉRALE Gazania and ASTÉRALE Cassinia brands, and to institutional sites (ORIAS, AMF, ACPR). ASTERALE has no control over third-party sites and accepts no liability for their content or their data protection practices.

Cookies and third-party services

The asterale.fr website sets no audience measurement cookies or advertising trackers and uses no behavioural analytics tool. The "Book a slot" button opens the Calendly calendar on its own website; any cookies Calendly may then set are governed by its policy. Details are given in the privacy policy.

Personal data

ASTERALE is the controller of the personal data collected on this site and in the course of its services, in accordance with Regulation (EU) 2016/679 and the French Data Protection Act as amended. Purposes, retention periods, recipients and the rights of data subjects are set out in the privacy policy.

Complaints and mediation

Any complaint may be sent by email to sebastien.bailly@asterale.fr or by post to ASTERALE, 4 allée Django Reinhardt, 94110 Arcueil, France. ASTERALE acknowledges receipt within ten working days and gives a reasoned reply within two months.

Failing a satisfactory reply, a consumer client may refer the matter, free of charge, to the competent mediator:
